The Living Legacy Project LLC is committed to protecting the privacy of our users and the families and storytellers who entrust us with deeply personal content. This Privacy Policy describes what information we collect, how we use it, and the choices you have about your data.

1. Information We Collect

Information you provide directly

• Account information. Name, email, password, and billing information when you create an account or subscribe.
• Storyteller information. Name, location, and background details of the person whose stories you wish to capture.
• Facility information. Name, address, and contact information of the care facility, senior center, or other location where sessions will be conducted, where applicable.
• Photos and videos. Images you attach to a story prompt, or photos and videos you upload for a legacy video product.
• Story prompts and portal activity. Topics, memories, and questions you submit through your family portal.
• Communications. Messages you send us by email, contact form, or other means.
• Partnership inquiries. Information submitted by facility or organization representatives through our partnership forms.

Information collected automatically

• Usage data. Pages visited, time on site, referring URLs, browser type, and device information.
• Cookies. Small files stored on your device to maintain your session, remember preferences, and analyze site usage. See Section 7.

Session recordings and archive content

Audio recordings captured during story-gathering sessions, including Story Time, are stored in your private family archive, accessed only by you, family members you authorize, and our team for quality assurance and production purposes.

2. How We Use Your Information

• To create and manage your account, subscription, or Story Time purchase.
• To coordinate and schedule in-person sessions.
• To deliver session recordings to your private family archive.
• To process payments and send billing-related communications.
• To respond to your questions, requests, and support inquiries.
• To improve our Services through aggregate usage analysis.
• To send service-related updates. You may not opt out of these while your subscription is active.
• To send optional marketing communications. You may opt out at any time via the unsubscribe link.

3. How We Share Your Information

We do not sell, rent, or trade your personal information. We share information only in the following circumstances:

Service providers

• Payment processing. We use GoHighLevel and Stripe, our payment processor, to process billing. Your payment card data is handled directly by Stripe and is not stored on our systems.
• Archive storage and delivery. Session recordings are stored and delivered via AWS.
• Audio editing. Session recordings are processed through Descript, an audio and video editing platform, to remove silence, background noise, and unusable portions before your archive is finalized. Descript is contractually bound to use your recordings only to provide this editing service to us.
• CRM and communications. We use GoHighLevel to manage customer relationships and communications.
• Story gatherers. Our trained guides receive only the information necessary to conduct your session: the storyteller's first name, general location, and any relevant background or health context you have provided. Guides do not receive your billing information or full account details.

All service providers are contractually bound to use your information only to provide services to us and to maintain appropriate security standards.

Legal requirements

We may disclose information if required by law, subpoena, court order, or other legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of our company, our users, or the public.

Business transfers

In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you by email and/or a prominent notice on our website prior to such a transfer.

4. Session Recordings and Archive Content

Audio recordings captured during your sessions are stored in your private, password-protected family archive. Access is limited to:

• You and family members you explicitly authorize.
• Our team, solely for quality review and, where ordered, legacy product production.
• Descript, solely to perform the editing steps described in Section 3.
• No other third party for any other purpose, ever, without your explicit written consent.

We do not use session recordings for marketing, training, product development, or any purpose other than delivering your archive and fulfilling ordered legacy products. Promotional use of any session content requires separate written consent from both the account holder and the storyteller or their authorized representative.

5. Data Retention

We retain your account information for as long as your account is active. If you cancel your subscription, your archive and account information are retained so you can continue accessing your recordings. You may request permanent deletion of your account and associated data by contacting us. Upon deletion, your archive and personal data will be removed within 30 days, except where retention is required by law.

Billing records are retained for the period required by applicable tax and financial regulations.

6. Data Security

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction, including encrypted transmission (HTTPS/TLS), access controls on our internal systems, and security-certified third-party infrastructure (AWS).

No method of transmission or storage over the internet is 100% secure. In the event of a data breach affecting your information, we will notify you as required by applicable law.

7. Cookies

We use cookies and similar technologies to keep you logged in, remember your preferences, and analyze site traffic. You can control cookies through your browser settings. Disabling cookies may affect your ability to log in to your archive.

8. Third-Party Links

Our website may contain links to third-party websites, such as facility partner pages or payment processors. We are not responsible for the privacy practices of those sites.

9. Children's Privacy

Our Services are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it promptly.

10. Your Rights and Choices

Depending on your location, you may have rights including:

• Access. Request a copy of the personal information we hold about you.
• Correction. Request correction of inaccurate or incomplete information.
• Deletion. Request deletion of your personal information, subject to legal retention requirements.
• Portability. Request a machine-readable copy of your data where technically feasible.
• Opt-out of marketing. Unsubscribe at any time using the link in any marketing email.

We may update this Privacy Policy from time to time. We will notify you of material changes by email to your registered address and by posting the updated policy on our website with a new effective date. Continued use of our Services after the effective date is acceptance of the updated policy.
