The Living Legacy Project (“we,” “our,” or “us”) is a storytelling and memorial-video
service created to help long-term care residents preserve their life stories for the
generations who will carry them forward. We honor every resident and family we serve
by protecting their information with care, transparency, and dignity.
This Privacy Policy describes how we collect, use, share, store, and protect personal
information within the Living Legacy Project and its parent joint-venture operator,
Rogue Healthcare Marketing.
1. Information We Collect
1.1 Resident & Family Information
- Names, contact details, and relationship information
- Recorded audio, video, and likeness of residents
- Photos, videos, or written materials submitted by families
- Scheduling information
- Personal or sensitive details voluntarily disclosed during storytelling
- Adult family member account information (email, billing information, communications)
Sensitive Story Content: Residents may share personal histories, beliefs,
family dynamics, or other sensitive information. These disclosures are voluntary and treated
with confidentiality.
Minors: We do not collect information from minors. Only adult family
members may create accounts or receive memorial materials.
2. Facility & AFH Information Collected
For resident storytelling services, we collect:
- Basic administrator contact information
- Scheduling and coordination details
For fractional marketing services through Rogue Healthcare Marketing, we may collect:
- Operational and business information
- Branding assets and marketing materials
- Analytics and performance data
3. Recorded Sessions & Media Rights
3.1 Ownership
- The Living Legacy Project owns the edited memorial video(s).
- Families retain ownership of raw photos, videos, and written material they provide.
- The resident’s story itself always belongs to the resident.
3.2 Sharing of Recorded Sessions
All recorded story sessions and uploaded media are shared with the
designated adult family member who manages the account. These materials
cannot be restricted or hidden from them.
3.3 Use in Marketing
We will not use resident recordings or family-submitted media for
marketing or promotional purposes.
4. How We Use Information
- Produce and deliver memorial videos
- Communicate with families and facilities
- Schedule and coordinate recording sessions
- Provide customer support and account management
- Improve our services
- Deliver fractional marketing services (when applicable)
- Comply with legal obligations
We do not sell personal information to third parties.
5. How We Store and Protect Information
5.1 Storage Systems
- GoHighLevel (scheduling)
- Stripe (payment processing)
- Gmail / Google Workspace (communication)
- Adobe Creative Cloud (editing)
Payment information is handled exclusively by Stripe. We do not store full payment data.
5.2 Security
We use reasonable technical and administrative safeguards to protect data. While no
system is perfectly secure, we are committed to treating resident and family information
with confidentiality and care.
6. HIPAA Notice
The Living Legacy Project is not a HIPAA-covered entity. Our services
are not intended to collect medical records. However, residents may voluntarily share
health-related details during storytelling, and these are kept confidential.
7. Data Sharing
We may share information with:
- The approved adult family member on the account
- Rogue Healthcare Marketing (administrative purposes)
- Contractors assisting with editing or production
- Vendors supporting scheduling, hosting, or communications
- Long-term care facilities coordinating session logistics
We do not sell personal information.
8. Data Retention
Media Files
Media (recordings, photos, video files) are stored for
up to 3 years from the final story-gathering date unless the family
has fully paid and requests deletion sooner.
Account & Operational Data
Retained indefinitely unless a deletion request is submitted.
Deletion Requests
Families or approved representatives may request deletion, correction, export, or
closure of their account. Deleted media cannot be restored.
9. Family Rights & Access
- View all uploaded and recorded materials
- Receive memorial reports and final videos
- Submit one edit request to a final video
- Download files during the 3-year access period
- Request deletion or export of data
10. International Privacy Rights
We honor internationally recognized privacy rights—such as access, correction, deletion,
and data portability—regardless of where a family member resides.
11. Cookies & Website Analytics
Our website and scheduling tools may use cookies, analytics platforms (e.g., Google
Analytics), and tracking pixels to improve performance and user experience.
