These Terms of Service govern access to and use of The Living Legacy Project's website, services, and products (the Services), provided by The Living Legacy Project LLC. By subscribing to or using our Services, you agree to be bound by these Terms.
The Living Legacy Project offers guided audio story-gathering, delivered two ways: an ongoing subscription, and Story Time, a one-time group session. Upon subscribing, we coordinate in-person audio story-gathering sessions between a trained guide and your designated storyteller, often a parent, grandparent, or other loved one. Story Time is a single in-person session, typically offered at a facility or community event, priced and billed separately from subscriptions under Section 2a. Sessions are conducted in person at the storyteller's location. Recordings are delivered to your private family archive, accessible through your account portal.
Subscription Services are offered on a recurring basis. By subscribing, you authorize us or our authorized payment processor to charge your payment method on a recurring basis at the rate and frequency tied to your selected plan, in U.S. dollars.
Story Time is a one-time purchase, not a subscription, and is not subject to the recurring billing terms in Section 2. Payment is due at the time of booking. Story Time sessions are typically delivered in a group setting at a facility, senior center, or community event, and the delivered recording is shorter than a standard subscription session.
You may cancel your subscription at any time by contacting us at support@thelivinglegacyproject.net. Cancellation takes effect at the end of the current billing period. We do not charge for months in which no session was conducted due to circumstances beyond your or our reasonable control.
All session recordings already in your archive remain accessible following cancellation. We do not delete your archive upon cancellation.
Refunds for completed sessions are not generally available, as sessions represent delivered services. If a session was not conducted with the quality and care described in these Terms, contact us within 14 days of the session date. Story Time purchases follow the same refund standard.
All story-gathering sessions, including Story Time, are conducted in person. We do not offer video call, remote, or telephone-based sessions. Our guides travel to the storyteller's location. By subscribing or purchasing Story Time, you acknowledge that in-person coordination is required and that sessions depend on the availability and accessibility of the storyteller and, where applicable, their care facility or event location.
We coordinate scheduling directly with care facilities, family homes, community organizations, or other locations. You agree to provide accurate location and contact information for your storyteller and to assist in facilitating reasonable access where needed.
You are responsible for maintaining the confidentiality of your account login credentials. Your family archive is private and accessible only to account holders you have authorized. We are not responsible for unauthorized access resulting from your failure to protect your credentials.
Your archive is provided for personal, non-commercial family use only. You may share access with family members. You may not distribute, resell, publicly broadcast, or commercially exploit recordings without our prior written consent.
Legacy products, including memorial videos, printed story books, produced podcasts, QR keepsakes, and raw audio feeds, are ordered separately and subject to separate product agreements and pricing at the time of order. Where a legacy product requires you to upload photos or videos, you represent that you own or have the right to share that content, and you grant us a limited license to use it solely to produce your ordered product.
Before conducting any session, we obtain written consent from the storyteller, or their authorized representative where the storyteller lacks capacity to consent independently. We do not conduct sessions without this consent. You represent that you have the authority to authorize sessions for the designated storyteller and that any representative consent you provide is valid under applicable law.
No session content is shared publicly or used for promotional purposes without separate, explicit written consent from both the account holder and the storyteller or their authorized representative.
Our guides are experienced working with older adults, including those with dementia, Alzheimer's disease, and other cognitive conditions. We adapt our approach to each storyteller's condition and pace. We cannot guarantee outcomes, and some sessions may yield limited results depending on the storyteller's health on a given day. Sessions that are not productive due to the storyteller's condition will not be billed.
You retain ownership of the personal content captured during sessions. You grant us a limited license to store, process, and deliver that content to your archive. We do not claim any ownership interest in your family's stories or recordings.
All website content, branding, design, software, and materials created by The Living Legacy Project remain our intellectual property and may not be reproduced without permission.
To the maximum extent permitted by applicable law, The Living Legacy Project and its officers, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of recordings, loss of data, or loss of archive access, arising from use of or inability to use our Services. Our total liability for any claim shall not exceed the total amount paid by you in the three months preceding the claim.
We are not responsible for technical failures of third-party platforms used to deliver, store, or process your archive. We take reasonable steps to maintain data integrity and redundancy but cannot guarantee uninterrupted access.
The Services are provided as is and as available without warranty of any kind, express or implied. We do not warrant that sessions will always be schedulable within a given timeframe, that recordings will meet any specific quality standard beyond our reasonable professional effort, or that the archive platform will be available at all times without interruption.
These Terms are governed by the laws of the State of Washington without regard to its conflict-of-law provisions. Any dispute shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved by binding arbitration in King County, Washington, under the rules of the American Arbitration Association.
We may update these Terms from time to time. We will notify you of material changes via email to your registered address at least 30 days before the change takes effect. Continued use of the Services after the effective date is acceptance of the updated Terms.
