Terms of Service

Welcome to The Living Legacy Project LLC (“The Living Legacy Project,” “we,” “our,” or “us”). The Living Legacy Project LLC is a storytelling and memorial-video company operated in collaboration with Rogue Healthcare Marketing and Casker Creative.

Our work centers on dignity, memory, and preserving the stories that matter most.

These Terms of Service (“Terms”) govern your use of our services, including resident story sessions, subscription-based legacy capture plans, memorial video creation, family portals, and related offerings (collectively, the “Services”).

By creating an account, scheduling a session, submitting media, or otherwise using our Services, you (“you,” “account owner,” or “family member”) agree to these Terms. If you do not agree, please do not use the Services.


1. Services We Provide

Our Services include, but are not limited to:

  • Filmed story sessions with long-term care residents

  • Subscription-based ongoing legacy story capture

  • Editing and delivery of memorial videos

  • Family-facing portals for viewing and downloading materials

  • Coordination with long-term care facilities

  • Fractional marketing services for Adult Family Homes

We may update or modify the Services from time to time. Any new features or tools shall also be subject to these Terms.


2. Accounts, Eligibility & Roles

2.1 Family Account Owner

  • The primary account must be created by an adult family member or legally authorized representative.

  • The account owner is responsible for payment, communications, and decisions related to the memorial video.

  • The resident must either:

    • Provide consent directly when they retain capacity; or

    • Have consent provided by a legally authorized representative (e.g., POA or guardian).

2.2 Facilities & Adult Family Homes (AFHs)

Long-term care facilities and Adult Family Home (AFH) owners may coordinate scheduling and provide logistical support. They are not owners of recorded materials or final memorial videos.

2.3 Independent Contractor Status

The Living Legacy Project LLC operates as an independent contractor and is not an employee, agent, healthcare provider, or representative of any long-term care facility or Adult Family Home. Facilities provide access and scheduling support only and are not responsible for the content or delivery of memorial videos.

2.4 Age Requirement

Only adults may create accounts and enter into these Terms. We do not provide Services directly to minors.


3. Bookings, Pricing & Payments

Pricing for memorial videos, subscription plans, and related packages is presented at the time of booking or as communicated directly by The Living Legacy Project.

3.1 Payment Processing

  • Payments are processed via Stripe or another third-party payment processor.

  • We do not store full payment card numbers or bank account details.

  • By submitting payment information, you authorize charges for the selected Services.

3.2 Taxes & Fees

You are responsible for any applicable taxes or fees associated with your purchase.


3.3 Subscription Plans & Billing

Ongoing legacy story-gathering subscriptions continue on a recurring basis until the account owner elects to end story-gathering sessions and cancel the subscription.

Subscription billing continues until the account owner provides notice of cancellation. Cancellation takes effect at the end of the current billing cycle unless otherwise agreed in writing.


3.4 Transition to Production

Upon cancellation of the subscription, the project will transition into production mode for editing and final assembly.

After transition into production mode, families may request a reasonable period to submit final photos, videos, or written materials for inclusion.

The Living Legacy Project will notify the account owner when media submission has closed and the project has officially entered final production.

Final memorial videos will be delivered within three (3) business days after media submission has closed and the project has entered final production.

Delivery occurs when the final memorial video is made available through the family portal or secure download link.

Delivery timelines may be extended if required materials are delayed, incomplete, or if circumstances beyond our reasonable control affect production.


3.5 Early Production Requests

The account owner may request early production of a memorial video while continuing active story-gathering sessions.

In such cases:

  • The video produced will reflect content captured and materials submitted up to the date media submission closes for that production cycle.

  • Additional story sessions conducted after delivery may be incorporated into a future updated memorial video, which may require an additional editing fee.

  • Early production does not automatically terminate the subscription unless the account owner cancels it.


4. Cancellations, Refunds & Resident Refusal

4.1 Standard Cancellation Policy

  • You may cancel and receive a full refund if you cancel before the first recording session occurs.

  • Once the first recording session has begun, payments are generally non-refundable, subject to Section 4.2.

4.2 Resident Refusal or Inability to Record

If across the first three (3) scheduled sessions:

  • The resident refuses to be recorded; or

  • The resident is unable to meaningfully participate; and

  • No usable audio story content is captured,

the account owner may choose either:

  1. To request cancellation and receive a full refund; or

  2. To proceed with a photo/video-only memorial at a 10% discount off the original memorial package price.

If the account owner elects to proceed with the photo/video-only memorial, the service will be treated as delivered once the final memorial video is provided, and no refund will be available.

4.3 Circumstances Beyond Our Control

We are not responsible for delays or non-completion caused by:

  • Resident health changes

  • Facility schedule changes or access limitations

  • Family unavailability or lack of submitted materials


5. Scheduling & Coordination

Scheduling and rescheduling are typically coordinated with the long-term care facility or AFH.

We are not responsible for repeated cancellations or no-shows by the resident or facility.


6. Content, Media & Ownership

6.1 Ownership

The Living Legacy Project LLC owns the edited memorial video(s) that we create.

Families retain ownership of raw materials they submit.

6.2 License to Families

We grant a perpetual, non-exclusive, worldwide, royalty-free license for personal, non-commercial use.

Memorial video(s) may not be modified, sold, licensed, publicly distributed for commercial purposes, used in advertising, or otherwise exploited without prior written consent.

6.3 Marketing Use

We do not use recordings in marketing without explicit written permission.

6.4 Accuracy & Artistic Nature

We are not responsible for factual inaccuracies in stories shared by the resident.

Memorial videos are creative works. We do not guarantee the final product will meet subjective artistic preferences.

6.5 Storage & Archiving

Final memorial videos are stored for up to three (3) years from delivery.

After that time, files may be permanently deleted without notice.

Families are responsible for downloading and backing up their video(s).

6.6 Submitted Media Warranty

You represent that you have the legal right to submit materials provided.

You agree to indemnify and hold harmless The Living Legacy Project LLC from claims arising from submitted materials.


7. Data Privacy

Your use of the Services is governed by our Privacy Policy.


8. No Medical or Legal Advice; HIPAA Notice

We are not a healthcare provider and are not a HIPAA-covered entity.


9. Limitation of Liability

To the fullest extent permitted by law, The Living Legacy Project LLC and its owners, employees, contractors, affiliates, and partners shall not be liable for indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid for the specific Service at issue.


10. International Users

Information may be processed in the United States.


11. Governing Law & Venue

These Terms shall be governed exclusively by the laws of the State of Florida.

Any dispute shall be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to jurisdiction and venue there.


12. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.
